Rabat – Here is a press release from the Royal Cabinet:
“His Majesty King Mohammed VI, Amir Al Mouminine, may God help him, President of the High Council of Ulemas, was kind enough, this Friday 21 Dou Al Hijja 1445 AH corresponding to June 28, 2024, to give His High Directives to the said Council, to examine certain questions contained in the proposals of the Body responsible for revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its tolerant designs, and to submit a Fatwa on them to the High Appreciation of the Sovereign.
This referral comes after the Authority responsible for revising the Family Code accomplished its mission within the allotted time frame and submitted its proposals to the High Appreciation of His Majesty the King. Considering that certain proposals are related to religious texts, the Sovereign decided to refer the matter to the Superior Council of Ulemas which is, in accordance with article 41 of the Constitution, the only body empowered to pronounce officially approved Fatwas.
The Sovereign also invited the Higher Council of Ulemas to take into account in the development of its Fatwa the content of the Royal Letter addressed to the Head of Government, which calls for the adoption of the virtues of moderation and Ijtihad open and constructive, while taking into consideration the norm repeatedly advocated by His Majesty the King, may God preserve him, according to which one cannot authorize what is prohibited, nor prohibit what is authorized”.
