Lindt & Sprüngli has won its case against Aldi Suisse before the commercial court of the canton of Aargau regarding a violation of trademark rights. The Swiss subsidiary of Aldi must stop distributing its own chocolate balls imitating Lindor balls.
The court followed the argument of the chocolatier from Kilchberg (ZU) who claimed that Aldi’s “Moser Roth” chocolate balls imitated Lindor balls.
The judgment was handed down on December 14 and published shortly before Christmas, the Aargauer Zeitung reported.
A possible complaint
In Switzerland alone, Lindor boules bring in 44.8 million francs in turnover for Lindt & Sprüngli, we can read in the judgment.
With its “Moser Roth” brand, Aldi has been selling a Christmas edition of its products, packaged in red and blue packaging since October 2024.
Lindt & Sprüngli now has until March 13, 2025 to file the main complaint against Aldi Suisse.
Not the first affair
The Aargau commercial court recognized that the sales ban will weigh on Aldi’s turnover and profits during the Christmas period. Lindt & Sprüngli will therefore have to post a guarantee of 200,000 francs.
This is not the first time that Lindt & Sprüngli has complained in court about the violation of its trademark. A Munich court had banned a manufacturer from selling its Easter bunnies wrapped in gold foil because it imitated the Kilchberg group’s golden bunnies.
