Dozens of Alsatian motorists, outraged at having been caught at Swiss customs on October 31, filed an appeal with the Jura public prosecutor.

Christian doesn’t lose his temper. “I have been making this journey every day for five years and this is the first time that I have been caught at the border post” of Lucelle (JU), relates the fifty-year-old in The Parisian. Flashed at 33 km/h instead of 20, this employee of a Swiss watch brand received a fine of 80 euros. And he’s not the only one.

On October 31, 234 vehicles were checked between 5:50 a.m. and 9 a.m., during rush hour. However, 211 exceeded the authorized speed, or more than 90% of the drivers checked that day! A particularly high offense rate which could be explained by an unknown subtlety of Swiss law.

It is in fact stipulated that drivers must “cross the customs area at a speed of 20 km/h at most”, even if the post is disused, even if no speed limit is posted and even if, as is the case in Lucelle, a sign reminding the “general limit” of 50 km/h is posted a few dozen meters upstream.

The affair hit the headlines at the time and numerous press articles raised the anger of the fined border crossers. The Haut-Rhin Border Workers Defense Committee (CDTF) also reacted, its president Jean-Luc Johaneck denouncing “a real ambush, well premeditated”.

The association subsequently launched an appeal on Facebook and brought together the grievances of dozens of angry motorists. An appeal has been filed with the Jura public prosecutor and could well be successful. Quoted by The Parisianthe attorney general of the Swiss canton says she is considering “reducing sanctions in the name of illegality (red: character of what is contrary to the provisions of the law)” and recognizes “a particular situation”.
