In April 2020, Kouddar had grabbed security guard Philippe Jean in the parking lot of the Walmart in the Fleurimont borough, killing the man. A video of the altercation was also filed as evidence in the case.

Judge Fabi, however, considered Nacime Kouddar’s version to be credible and stressed that Philippe Jean’s behaviour was “aggressive” and “unpredictable” towards the accused.

“The court confirms that the accused’s version is credible and believes it. […] The accused had no choice but to act as he did,” Ms. Fabi wrote in her judgment.

She often stressed that the accused had acted in self-defense and that Philippe Jean had made racist remarks, in addition to having put himself in the path of Kouddar’s vehicle, which he then punched before falling out after a few turns of the steering wheel.

“The video […] is eloquent about the actions of Philippe Jean. He behaves aggressively from start to finish […]“, mentioned Ms. Fabi.

Philippe Jean succumbed to his injuries in August 2020, after a four-month coma. He was the father of five children.
