I continue with another cry of alarm, that of retired conservative judge Michael Luttig facing a conservative majority of the Supreme Court which he considers abnormal but which seems to want to contribute to the normalization of Donald Trump.

Michael Luttig poorly conceals his outrage at this majority’s refusal to recognize the urgency of bringing Trump to justice in Washington for his role in an attempt to overturn the results of the 2020 presidential election, an attempt that culminated in the assault on the Capitol on January 6, 2021.

“If a president cannot be held responsible under the Constitution for attempting to overturn an election he lost fairly, for remaining in power, and for preventing the peaceful transfer of power, it is is the heart and soul of American democracy and the rule of law that must be eliminated,” he denounced during an interview with the host of the AF podcast.

Luttig brought it up again during an interview with journalist Greg Sargent of the magazine The New Republic : “I am deeply troubled by the apparent direction of the Court. I now believe it is unlikely that Trump will ever be tried for the crimes he committed in trying to overturn the 2020 election.”

He added: “The conservative justices’ argument for immunity assumes that Jack Smith’s prosecution of Trump is politically corrupt and seeks to establish a rule that would prevent future presidents from corruptly prosecuting their predecessors. But such a rule would allow all future presidents to commit crimes against the United States while in office, with impunity. This is exactly what Trump claims he has the right to do. »

Josh Marshall, editor of Talking Points Memo, is neither a lawyer nor a conservative. But he finds only one word to explain the behavior of the conservative judges of the Supreme Court: corruption. “This is a misguided, totally corrupt court that has gone so far in its corruption that it feels free from the practical obligation to dress up its corruption to keep up appearances. »
