The motorcyclist was tried and convicted for acts committed on Friday December 27, in the middle of the afternoon, in Mosson. He had brushed against children during his rodeo.
There was a crowd at La Mosson on Friday, December 27, around 3:40 p.m. This was the moment that two bikers chose to do wheelies at high speed among the families, avenue de Heidelberg, near the parking lot of the Mosson, a playground and tram and bus stops.
Asking them in vain to stop their rodeo, police tried to secure the scene. They were provoked several times by the bikers. One of them, perched on a green motorcycle and wearing tracksuit bottoms and a sleeveless down jacket, got a little too close.
After brushing against a child on a bicycle, he lost control of his machine when crossing a median, before ending his course in the rear right corner of the police vehicle. He fell but got up to try to restart his motorcycle. It was at that moment that a police officer got out of the vehicle and tried to arrest him by putting him on the ground.
Fingers of honor to the police?
According to his testimony, the defendant refused to be handcuffed. It was only with the reinforcement of two other police officers that the motorcyclist was able to be brought under control.
Aged 32, Saïd was taken into police custody. The native of Montpellier admitted the facts, except the rebellion. And before the criminal court, this Monday, December 30, he also denied having given the fingers of honor to the police. He explained that “it was the other biker”. He could not be arrested.
The motorcycle was not approved or insured
“Okay, but how do you explain your behavior?”asked the president. “Stupidity”he replied lucidly. “I was scared, and I wanted to avoid having the motorcycle confiscated.”
The defendant had his license suspended for driving under drugs. The motorcycle used during the rodeo did not require a license, but it was not approved to ride on public roads. This machine, which the defendant claimed to have purchased for €3,000, was not insured either.
Among the three convictions appearing in the criminal record of this ex-facade painter, we find acts of contempt and violence against a member of the public force, in 2014. As well as the use of narcotics. “I smoke cannabis but only for pleasure”he told the judges.
“Disorderly behavior”
Married very young, he is the father of two children aged 8 and 5, one of whom is autistic. “I think this disordered behavior is partly due to the obstacle course of living with a disabled child.”argued his lawyer, Me Galix.
“The consequences could have been dramatic”underlined the prosecutor. She requested a 12-month suspended prison sentence, an obligation to seek treatment and to work or train, a road safety awareness course, the cancellation of her driving license with a ban on retaking it within six months, a fine of €450 and confiscation of the motorcycle.
It is this sentence which was applied by the judges. However, they acquitted the accused of acts of rebellion.
