Struggle, right to strike and retirement reforms on the menu

The Moroccan Front against strike and retirement laws (FMCLGR) organized, Monday December 16, 2024 in Rabat, a press conference aimed at highlighting recent advances relating to the organic law on the right to strike, pension reform project, as well as the Front’s action program, dissatisfied with these texts.

Indeed, the Front expressed its dissatisfaction with the content of draft organic law No. 97.15 defining the conditions and modalities for exercising the right to strike. He denounced the fact that this “ legislative text remains imbued with a series of restrictions considered severe and opens the way to the criminalization of this fundamental right, all under the pretext of guaranteeing the continuity of services« .

In addition, this legislation would consider the possibility of replacing striking workers with others, a provision which raises serious concerns about its impact on the rights of employees and the legitimacy of their industrial actions, added the FMCLGR.

Furthermore, members of the FMCLGR highlighted their commitment to making their voices heard against laws that threaten the right to strike and retirement. They also expressed their desire to initiate collaborations with other organizations, in order to harmonize efforts and exert significant pressure on the government with a view to countering this project which they describe as retrograde, to defend the achievements and promote genuine social dialogue that respects workers’ rights.

In a statement to Hespress FR, Tahar Douraidi, member of the executive office of the National Federation of the Agricultural Sector under the UMT explained that the Front organized this press conference with a view to “ to clarify the position of the members of the Moroccan Front regarding this law that the government is rushing to have adopted by its majority in Parliament, against the will of the unions, civil society associations, and the Moroccan working class« .

« This is a law that the government has been trying to pass since the last decade of the last century. From now on, he is taking advantage of his parliamentary majority to promote this retrograde legislation, which is nothing more than a gift intended for a wild employers, disrespectful of the laws and determined to put an end to any strike organized by workers to defend their rights and make assert their legitimate demands“, he informed our interlocutor.

Furthermore, the Front unwaveringly expressed its categorical refusal of several provisions contained in draft organic law No. 97.15, in particular those relating to the imposition of financial sanctions on strikers. It was also emphasized that “ the Ministry of the Interior shows an initial reluctance to provide unions with deposit certificates, thus creating a context where nearly 90% of trade union organizations find themselves deprived of these essential documents, which constitutes a significant obstacle to the exercise of union activity« .

Recall that the Social Sectors Commission in the House of Representatives voted in favor of the adoption of this bill with approval by 22 deputies against 7 in disagreement, without any abstention during the marathon vote held in the presence of the Minister of ‘Economic Inclusion, Small Business, Employment and Skills, Younes Sekkouri.
