Performed by Gilbert Montagné, the song “On va s’aimer” has made millions of French people dance since its release in 1983.

At the end of a long legal procedure, the singer and his lyricist Didier Barbelivien have just been found guilty of plagiarism.

They were accused of being inspired by a piece entitled “Une fille de ”, performed by the Italian Gianni Nazzaro.

This is one of Gilbert Montagné's essential hits. Or almost. The singer and his famous lyricist Didier Barbelivien have just been condemned for plagiarizing “On va s'aimer”. After a long legal battle, the Court of Appeal confirmed at the beginning of October a decision taken by the Italian courts in 2012.

At the time, it had been seized by Gianni Nazzaro, a transalpine singer who pointed out the similarities between “On va s'aimer” published in 1983, and his song “Une fille de France”, published in 1976… and of which Didier Barbelivien was also the lyricist, with Jean-Max Rivière and Michel Cywie writing the . Despite a decision by the Italian courts in favor of Gianni Nazzaro, Gilbert Montagné and Didier Barbelivien refused to pay him a single cent.

Italian justice therefore sued the two men, their publishing companies and SACEM to block their royalties. Twelve years later, the Paris Court of Appeal ruled. Not only will they no longer receive royalties in the future. But they will have to pay 30,000 euros in damages to the heirs of Gianni Nazzaro, now deceased. “It's a legal imbroglio: Didier Barbelivien cannot be prosecuted for plagiarism, because he is the lyricist of the two songs“, reacted to TF1 the artist's lawyer, Me François Binet.

The affair is all the more incredible given that in 2009, Gilbert Montagné himself filed a complaint against the Flunch brand, accusing it of having copied “On va s'aimer” by transforming it into “On going to fluncher” for the purposes of an advertising spot. He was awarded 30,000 euros in damages.
