Monday January 6, 2025, a defendant of Portuguese citizenship, having grown up in France, appeared before the Niort criminal court, for violence committed against his parents, on the night of December 31, 2024 to 1is January 2025, in Bressuire.
The 23-year-old man is already known to the courts, notably for traffic offences. As such, he is subject to an administrative obligation to leave French territory, notified on January 31, 2023. However, he enters France on December 21, 2024 “for the end of year celebrations”and to see his two and a half year old granddaughter again, whom he did not recognize at birth. He then lived with his parents.
Punches
On the night of December 31, the Bressuire gendarmes were called to their home. An argument broke out when the man returned from the evening, around 6 a.m. He is drunk. He knocks violently on the door. His mother then tries to push him away. He hits him “a punch to the head, a kick to the legs and grabs her by the neck”according to the president's account.
His father intervenes to defend his wife. He also responds with punches and kicks. “It was self-defense. My father has a grudge against me”underlines the defendant.
“He had the upper hand”
The father, who filed a complaint, is only asking for a symbolic euro in compensation. “Above all, he wants his son to take care of himself”explains the father's lawyer. The violence against the father led to eight days of temporary work interruption (ITT). “Here, the defense is not at all proportionate. Violence is an explanation but never a justification”points out the public prosecutor.
For Me Ambroise Garlopeau, defense lawyer: “He was punched as a child. He grew up. And that day for the first time in his life, he had the upper hand. »
The court pronounces a sentence of ten months' imprisonment and continued detention. He is ineligible for five years and is also prohibited from entering French territory for five years. Finally, he will have to pay a symbolic euro to his father.
