The Court of Appeal, the Judicial Court and the Orléans Bar (), in particular in collaboration with the Prison Integration and Probation Service (SPIP) of Loiret, organized a fictitious trial at the Orléans-Saran Prison Center , This Thursday October 17, 2024 .

The outcome of a project

This representation is actually the culmination of four workshops led by Delphine Bocchinochief of staff of the Attorney General, to fifteen inmates.

The theme: trial of Captain Richard Malinowskiinspired by the film “Contre-Enquête” by Franck Mancuso.

These budding actors have thus deciphered the scenario of the case, questioned the arguments presented by the defense and the prosecution and analyzed the investigation from all its angles.

Then, they immersed themselves in the key roles, learned to use their voice, to be convincing and to adapt to the solemnity of the assize trial.

Making justice more accessible

This project had the idea of make the functioning of the French judicial system more accessible to understandingespecially those who have already faced it.

A total immersion allowing everyone to realize the complexity of measured decision-making, respecting both the interests of society and the defense of the rights of the accused.

A standing ovation performance

Like a classic first instance assize trial, six popular jurors unfamiliar with the case were drawn at random among those detained at the start of the session.

Following the interrogation of the accused, the testimony of forensic experts and psychiatrists and testimonies of the brother of Daniel Eckman (victim), the wife of Richard Malinowski, Armand Sanislas and Christiane Carlier, the pleadings of the lawyers of the civil parties, those of the defense as well as the requisitions of the general advocate took place .

The president, the assessors (magistrates) and the six jurors deliberated behind closed doorsaccompanied by Daphné Melès, sentence enforcement judge at the Orléans Judicial Court.

The objective was to decide on guilt and set the sentencethe attorney general having requested 20 years of imprisonment.

A discussion began in parallel with the room, led by Maître Le Marchand, Prosecutor General as well as a substitute for the Orléans public prosecutor’s office. Finally, a vote was taken to decide on the sentence.

After more than half an hour of deliberation, the verdict was announced: Richard Malinowski was sentenced to 15 years in prison.

Nearly 40 detainees attended this fictitious trial. The performance of the actors, their involvement and their commitment to this project were praised at the end of the performance. They even had the right to a “standing ovation” as a sign of thanks..

“Counter-investigation”, by Franck Mancuso

Richard Malinowski is a captain in the judicial police. One day her life changes: her daughter, Emilie, is raped and murdered. Daniel Eckman is arrested and imprisoned. A counter-investigation then begins, Richard Malinowski seeks at all costs to exonerate Daniel Eckman, to everyone’s surprise and in particular that of his wife. He is finally released from prison. At her invitation, he goes to Richard’s house, they share a glass of wine, they visit Émilie’s room… Then, Daniel Eckman is found dead. He was buried alive.

The investigation, the arrest of the captain and his trial were imagined by Delphine Bocchino and her group.
