Siré Sy warns against certain dignitaries and officials of the old regime who became deputies to obtain parliamentary immunity and escape prosecution by the High Court of Justice. For the political analyst, this is an approach doomed to failure, because the Pastef party, with its 130 deputies, has the capacity to initiate the indictment.
“From a legal point of view, if members of the old regime seek to become deputies to escape the High Court of Justice, this turns out to be a wasted effort,” explains Siré Sy.
Indeed, according to the Seneweb columnist, once the High Court of Justice is installed, it is the National Assembly which carries out the indictment if it obtains a qualified majority, i.e. 3/5 (99) of the deputies. However, the Pastef party holds 130 seats.
“It is the High Court of Justice which judges, but it is the Assembly which initiates the indictment,” he adds.
