Allow everyone to live in a decent apartment. This was the wish of the City of Carrières-sous-Poissy (Yvelines) when implementing the “rental permit”. During the municipal council meeting of December 11, 2024, the municipality adopted this system which came into force on January 1, 2025.
This tool will require owners of certain neighborhoods – private and public lessors of houses or apartments – to complete a file ensuring sanitation of the property they wish to put on the rental market. Precise requirements and a reminder of standards and legislation will be required by the City in order to control any deviations.
“It is a system made possible by the Alur law of 2014 allowing just effectively against substandard housing,” specifies the mayor, Eddie Aït.
“This preventive tool will allow us to avoid the rental of unsanitary, energy-intensive or poorly maintained housing. This permit will protect future tenants and allow owners to ensure they are in compliance with the law. »
National system created to fight against slumlords, the rental license has already been adopted by more than 140 cities in France, proof of its usefulness.
Police visit and check
Concretely, owners are asked to obtain a Prior Rental Authorization (APML). They will therefore have to create a file (form and supporting documents) which will be submitted to the Department of Urban Planning and Local Economy. This will give a favorable or unfavorable opinion and will judge whether or not it is necessary toan on-site visitaccompanied by a member of the municipal police.
Six sectors
Please note, the APML is only requested if the property is located within one of the perimeters defined by the Municipality. “The City, in conjunction with the GPSEO urban community, has defined six sectors within which each owner will be required to submit an APML application. The perimeters were defined according to the types d’habitats : old or essentially to be reclassified,” explains the councilor.
These sectors are as follows: Center Ancien, Saint-Louis / Maurice-Berteaux, Vanderbilt, La Galiotte, Reine Blanche and Avenue de l'Europe (at the corner of Rue Jean-Monnet).
“The Department of Urban Planning and Local Economy is available to owners to submit their application for rental authorization. If necessary, she can direct them towards work to be done to comply with legal requirements,” specifies the City of Carrières-sous-Poissy.
How to create your file?
Your Prior Rental Authorization (APML) application file must include several documents:
→ Cerfa form n° 15652-01 completed and signed,
→ Technical diagnosis file (diagnoses and certificates established by professionals) including in particular:
. The energy performance diagnosis,
. The state of pollution risks dated less than 6 months,
. The condition of the electrical installations dated less than 6 years ago,
. The living space certificate.
The file can be submitted via a dedicated website, sent by e-mail or delivered to the town hall by post or by hand. After submitting your file, you will receive a receipt. This does not constitute rental authorization, it only serves as proof of submission of your application. The City has one month to review your file.
If it is granted to you, the rental authorization must then be annexed to the lease before it is signed. It must be renewed in the event of a change of tenant but not in the event of renewal of the lease. In the event of sale, it is transferable to the new owner.
Up to €15,000 fine
In the event of refusal, the owner will have to carry out work according to the recommendations of the City services. If, despite this negative feedback, an owner still rents out his property, he will be exposed to a fine of up to €15,000 and a ban on rentingThey are good.
“We do not want to constrain, we want to support owners so that they rent their property in the best conditions. »
Valid for 5 years
Once issued, the rental permit will be valid for one duration of 5 years with tacit renewal, if the tenant does not change. However, it must be renewed if the tenant changes before the end of its application.
Please note that accommodation located outside the scope of the rental permit, rentals seasonal tourist(less than 4 months in the year), commercial leases and social housing are not affected.
