In law, two different regulations apply. In Meurthe-et-Moselle, retail businesses have the possibility of opening twelve Sundays during the year, following municipal authorization.
In Nancy, shops will open this Sunday, January 5, all day. Under the Macron law, employees are entitled to double remuneration as well as equivalent compensatory time off. Interesting.
Local law less favorable to employees
In Metz, the Moselle departmental statute of May 18, 2015 authorizes the opening of businesses on the first Sunday of the winter sales but only within 5 hours. Thus, on Sunday January 5, commercial employees in Moselle will work on a voluntary basis, but local law does not provide for any increase in salary or specific compensatory rest, except under contractual or conventional provisions. In these conditions, the volunteers do not jostle at the gate…
So, there is indeed the territorial collective agreement of March 27, 2017. This agreement applies with interesting rewards: double remuneration, compensatory rest, coverage of travel, parking and catering costs. But this collective agreement was not extended by the Minister of Labor to all companies (due to opposition from Medef). Ultimately, only employees of the signatory companies benefit from this collective agreement.
A request from traders
A new element intervened on December 17: the prefect of Moselle issued an order authorizing the opening of businesses in the city of Metz on Sunday January 5 within the limit of 8 hours (and more five) based on the deviation from local circumstances making increased activity necessary. He can only act in the capital of Moselle, this power falling to the mayors of the other municipalities.
Laurent Touvet took this decree because he was sensitive to the request coming from the federation of Metz traders. “We really need it, we are seizing all the opportunities for additional opening and we are asking the prefect to support us,” explains Alban Bissielo, head of the Metz federation. He was receptive to our request. Nothing obliges merchants to open all day, but 100% of our members will do so. For example, restaurateurs will be able to open for lunch and dinner. And this Sunday in January is a way to prolong the spirit of the Christmas market. »
