Samuel Sarr, former Minister of Energy, has decided to take the matter to the Commercial Court to challenge the appointment of Abdou Karim Diop as interim general manager of West African Energy (WAE).
This designation, which occurred this weekend according to several media, follows the placement under arrest warrant of Samuel Sarr for misuse of corporate assets involving 8 billion FCFA, to the presumed harm of WAE.

Samuel Sarr questions the legitimacy of this decision. According to him, Moustapha Ndiaye, whom he accuses of having convened the Board of Directors (CA) to make this appointment, does not have the required competence. “Only an administrator, like Senelec, can convene the board of directors, and not a simple shareholder,” reports L’Observateur in its edition this Wednesday.
In addition, Samuel Sarr challenges Moustapha Ndiaye’s status as president of the Board of Directors of WAE. He claims that the latter was replaced in February by Papa Mademba Bitèye, former CEO of Senelec, then by Pape Toby Gaye, his successor. He thus filed a complaint for usurpation of office.

This is not the first time that Moustapha Ndiaye has appointed Abdou Karim Diop to this position. A similar decision taken in June 2024 is already pending before the Commercial Court, according to Me Baboucar Cissé, lawyer for Samuel Sarr, who announces a new legal challenge.
