A week before the first round of early legislative elections caused by the dissolution of the National Assembly following the European elections of June 9, the National Rally wants to “prevent” people with dual nationality from occupying “extremely sensitive jobs” the list of which will be defined “by decree”, announced Monday the deputy and vice-president of the National Assembly Sébastien Chenu, referring to “the most strategic positions of the State”.

The ban measure will relate to “extremely sensitive jobs, for example people who are dual Russian nationals to occupy strategic management positions in defense”, specified the MP on TF1, without giving further details on the type jobs concerned.

Asked about this proposal, the leader of the RN for the legislative elections, Jordan Bardella, replied: “I confirm to you that the most strategic positions in the State will be reserved for French citizens and French nationals”, his entourage then specifying that he implied “French citizens only”, excluding dual nationals.

“We don’t hear not call into question dual nationality (…). On the other hand, we actually intend to reserve a certain number of strategic jobs in sectors particularly linked to security and defense, exclusively for French citizens,” he added, noting that this concerns “very very few people “.

The measure will pass through “an organic law and and decree to prevent interference” because it is about “protecting ourselves”, in “sensitive sectors”, insisted Sébastien Chenu. “What we judge is nationality: you are French or you are not French. When you are French, you have the same rights as any French person, including when you have been French par naturalization in the past,” he added, recalling that in the event of victory for the far-right party in the early legislative elections, “it will probably be less easy to be French.”

A decision left to the discretion of the employer

He further reiterated that for the rest, people with dual nationality would have the same rights as others, unlike has what the RN proposed in 2022. “When you are Franco-this or Franco-that, you are French and you obviously have the same rights as any French person,” he clarified.

A binational French person has, legally, all the rights and obligations attached to French nationality. Currently, dual nationality does not prevent access to jobs of public service. Certain professions, called “sovereignty” because they are linked to the sovereign functions of the State (defense, budget, security, diplomacy), are reserved for French people, whether or not they theoretically hold a second nationality. The decision to classify a position among sovereignty jobs is left to the discretion of the employer, most often and ministry.

For the rest, European nationals can take competitive exams and become civil servants. Non-European foreigners can also be recruited into the civil service, but only as contract workers, a less protective status than that of civil servant.

In the private sector, there are no restrictions for dual nationals, according to experts in labor law interviewed by AFP. This “by virtue of the principle of prohibiting any discrimination in hiring established by article L1132-1 of the labor code”, explains Me Eric Rocheblave, lawyer specializing in labor law. But, he said, “what the legislator of yesterday did, that of tomorrow can undo it or restrict”.
