While he was definitively condemned on December 18 by the Court of Cassation in the wiretapping case, how could the former head of state fly thousands of kilometers from Paris? The judges of the Court of Cassation in fact sentenced him to three years in prison, including two years suspended, and to one year of “home detention under electronic surveillance”, that is to say under an electronic bracelet.
Four months for the sentence enforcement judge
As explained 20 Minutes after the conviction of Nicolas Sarkozy, the installation of the electronic bracelet is not necessarily immediate after the sentencing. The public prosecutor's office must, within one month, refer the matter to the sentencing judge, responsible for determining the terms of the sentence for the former head of state. Then, this same judge has four months after the sentencing to define these terms. When contacted, the Paris prosecutor's office told us that “the procedure is continuing”. Nicolas Sarkozy's lawyer did not respond to our requests.
All exit authorizations from which the former president will benefit during this one-year period must have been granted by the sentencing judge. These can be granted for professional reasons or for medical or family emergencies.
If he does not respect these obligations, Nicolas Sarkozy risks incarceration, like all people benefiting from this system.
