NGAGNE DEMBA TOURE “IF THE LAW IS APPLIED… BARTHELEMY DIAS WILL NO LONGER BE MAYOR OF DAKAR”
Me Ngagne Demba Touré responded to the mayor of Dakar through a press conference. He reacted following the removal of Barthélemy Dias from the National Assembly, affirming that the latter also risks losing his position as mayor of Dakar. According to him, if the law is strictly applied, Mr. Dias will no longer be able to exercise his functions. The Director General of the Senegal Mining Company (SOMISEN), responsible for Pastef, began by clarifying that Barthélemy Dias cannot be dismissed under article 135 of the Local Authorities Code, which requires conviction for a crime while Barth’ was convicted of an offense in the Ndiaga Diouf affair. He adds that article 277 of the Constitution stipulates that an elected official in a situation of ineligibility or incompatibility may be declared resigned by the representative of the State, unless appealed to the Court of Appeal within 10 days. . According to Me Touré, the combination of these two legal provisions allows any voter to contact the prefect to request the recognition of the resignation of Barthélemy Dias. “If the law is applied in the coming days, Barthélemy Dias will no longer be mayor of Dakar,” he concluded.

CASE DR MBACKE DIEYNABA NDIAYE IS FREE
The domestic violence case of Dr Alioune Badaa Macké against his ex-wife Dieynaba Ndiaye saw a new development yesterday. Imprisoned following a complaint for collection of illicit data from her husband, Dieynaba Ndiaye obtained provisional release. The judge of the criminal chamber of the Dakar Court of Appeal, who granted the woman’s freedom, thus satisfied the appeal of women’s associations. Dieynaba Ndiaye was a doubly victim: not only did she suffer domestic violence, but she was also imprisoned. Images showing her bloodied face were widely shared on social media, accompanied by the hashtag “Justice for Dieyna” at the time of the incident. Ironically, it was she who was detained for three months, accused by her husband of having shared intimate videos. However, Dieynaba Ndiaye did not give up. She filed a complaint against her husband, Alioune Badara Mbacké, for “wilful assault, violence, assault, insults and failure to assist a person in danger”. Ms Mbacké relied on a medical certificate attesting to a temporary incapacity for work (ITT) of 10 days, as well as on images of the violence she suffered. The husband was ultimately sentenced to 45 days in prison.

SCAM MAYOR OF SEMME HABIBOU TIMBO IN PRISON.
The mayor of Semmé Habibou Timbo spent his first night in prison yesterday. He was placed under arrest warrant at the same time as his cousin Aïssatou Ngaïdo by the investigating judge of the 2nd cabinet at the Pikine-Guédiawaye district court.
