This day of Friday, November 15 begins with the indictment of the attorney general, she reminds the jurors that they will have to form an intimate conviction during this day, she specifies that this trial is that of stolen innocence.
Eythan is unanimously described as a child full of life, kind, smiling, discreet… or rather “assigned to discretion”, due to the full days spent alone in his room.
Only two people were present in the accommodation with the child
She continues in these terms: “I believe that the two accused are responsible for the death of Eythan” There are two certainties in this case, on the one hand, Eythan died a violent death following the intervention of 'a third and on the other hand, apart from the little victim, there were only two other people in this accommodation.
Similarities with other acts of violence
On the day of the events Gaël Scoubart was in the same state as five years ago when he attacked his aunt, shaking her and throwing her into a hedge for a trivial reason. He had lost his temper, lost his temper, was under the influence of alcohol and potentially in a state of withdrawal.
No intention of causing death?
The attorney general then expresses her conviction, “the accused committed the actions which caused Eythan's death” but: “Did he intend to kill?” I don't believe it. “
Follow-up care for dogs… not for Eythan
His speech then goes to the mother of little Eythan who admitted the facts of lack of care. She admitted that her son had not seen a doctor in two years, that she had never even taken his temperature. Unlike dogs who were taken to the vet on time!!!
20 years of criminal imprisonment required
To close her indictment, this magistrate requires a sentence of 20 years of criminal imprisonment against Gaël Scoubart with a security period of half of the sentence that will be pronounced. Tears then flow down the face of the accused.
Concerning Lisa Duguet, the magistrate requests that the Court enter into the process of sentencing for the two offenses and requires a sentence of five years of imprisonment, one of which is accompanied by a probationary suspension. The deposit warrant is requested.
A virtual life, with a virtual family
Maître Le Goardet takes the floor to defend his client Lisa Duguet. The investigation and the debates clearly demonstrated that her client was “disconnected from reality”. She describes herself as a bad mother. For this lawyer, the elements of the offense of endangering the lives of others are not present. She recalls that her client has already been incarcerated for 18 months in pre-trial detention, “There is no need to send her back behind bars, she will carry her burden all her life”.
A proper attack on the judicial institution
Finally, it is the pair of defenders of Gaël Scoubart who speak out, they took turns hammering out the failures of the judicial institution in this case. From the stubbornness of the investigators to the lack of perspective of the investigating judge to the pressure endured by the prosecution. The defense system is clearly displayed.
Master Delilaj speaks: “We told you how this child died but we didn't tell you when!!! » He wonders why no one takes responsibility for hindering the manifestation of the truth. The child's body temperature was not taken, the criminal identification technician, the emergency physician, the forensic pathologist.
Cast doubt on the perpetrator of the violence
Only one thing is certain, the person who committed the acts, whether his client or his partner, did not intend to kill. This lawyer ends his argument by addressing the jurors: “No one is forcing you to save the deficiencies of the investigation and the judicial institution.”
Master Jourdain-Demars takes over for a demonstration, in order to try to establish the supposed time of Eythan's death. It would have intervened between 3 and 7 a.m. on the night of Saturday July 9 to Sunday July 10, 2022. At that time, his client declared that he was sleeping, his partner was active on her phone until 5 a.m.
Then he asserts by way of closing, also addressing the jurors: “You can say “I don’t know” and vote blank, knowing that the blank vote is favorable to the accused. I ask you to pay it in your soul and conscience. »
The two accused then speak in order to put an end to the debates. Lisa Duguet has prepared a short document and is requesting authorization from the President of the Court to read it. In it, she apologizes to those close to her and asks them not to feel guilty, that she is the only one at fault.
As for Gaël Scoubart, he repeats once again that he is innocent, as he has always claimed. He also states that he loved Eythan deeply.
It is 2 p.m., the jurors retire to deliberate.
After more than 7.5 hours of deliberations, the Court returned to the courtroom, which, despite the late hour, was packed.
The sentence comes to everyone's surprise. The jurors did not take into account the requisitions of the attorney general and maintained the classification of murder against Gaël Scoubart.
He was sentenced to 30 years of criminal imprisonment with a 20-year security period.
On the other hand, Lisa Duguet, 25 years old, receives the required sentence, for failure to provide care or food compromising the health of a fifteen-year-old minor and failure to assist a fifteen-year-old minor in danger. The committal warrant is issued against him.
When the verdict was announced, Gaël Scoubart's mother stood up and shouted: “What a shame, you have no proof, it's a shame! », before being asked to leave the room by the hearing police, at the request of the president.
The two ex-spouses leave the accused box, handcuffed, each supervised by their escort.
