The police officer accused of fatally shooting Olivio Gomes, a motorist, in Poissy (Yvelines) in 2020, will be referred to an assize court for intentional homicide, the Versailles Court of Appeal confirmed.

The investigating chamber of the Versailles Court of Appeal confirmed, this Tuesday, June 18, the referral to an assize court for intentional homicide of the police officer accused of having fatally shot Olivio Gomes, a motorist he had been followed in 2020 in Poissy.

“The investigating chamber confirmed the indictment,” the public prosecutor told AFP. During the hearing on May 21, Me Ndiogou Mbaye, lawyer for the civil parties, pleaded for confirmation of the referral for murder. The attorney general also requested confirmation.

The police officer’s lawyer did not wish to speak to AFP. Contacted, Me Ndiogou Mbaye did not respond late Wednesday afternoon.

Police officer denies homicidal intent

The BAC night police officer from Paris is accused of having killed Olivio Gomes after following him to the bottom of his home in the Beauregard city, on the night of October 16 to 17, 2020. Olivio Gomes was hit by three shots: in the shoulder, neck and left shoulder blade. The second, fatal, perforated both of his lungs.

A judicial investigation for murder was opened on October 21, 2020 and the police officer indicted and placed under judicial supervision. According to the conclusions of the investigating judge, these three shots were not a “proportionate” solution.
