Tried in April 2024 in the case of a serious workplace accident, three companies were sentenced this Thursday, May 2 by the criminal court of Brive (Corrèze).

In this case of a work accident, which occurred in Brive (Corrèze) on June 30, 2021, the prosecution’s requisitions were followed to the letter. In its deliberations, delivered this Thursday, May 2, 2024, the Brive criminal court recognized the three companies responsible for being at the origin of the injuries suffered by an employee. During the hearing, the public prosecutor did not mince its words, pointing out “a combination of approximation and amateurism” on the part of the three companies.

A lifting machine falls on him

As a reminder, on the day of the incident, the victim employee was instructed by his employer to collect a lifting machine, weighing more than a ton and a half, from a building construction company in Brive. On site, the pallet needed to load it was not there. Employees present then used a forklift belonging to a third adjoining material recovery company to successfully lift the jack to the truck. The defective machine ended up giving way, “seriously” injuring the driver (55 days ITT).

The Brive criminal court declared the three companies responsible for the employee’s injuries. SAS Récup Matériaux was ordered to pay a fine of 10,000 euros for unintentional injuries, the company Maintenance et Travaux Spéciaux was fined 15,000 euros and the company Transport Many was fined 5,000 euros, including 2,500 euros suspended. The issue of damages was referred to a civil interest hearing.
