If both motions are rejected, the bill is considered adopted. In the event that one of them is adopted, the text is rejected and the Government must submit its resignation.
Article 49 paragraph 2 of the Constitution determines the conditions of admissibility and discussion of motions of censure whether they are tabled “spontaneously” by deputies or in response to the Government's commitment to responsibility for a text.
To be admissible, a motion must be tabled by at least one tenth of the members of the National Assembly. Once the motion is filed, no signature may be added or removed. The list of signatories is published in the Official Journal as an annex to the full report of the debates.
A motion of censure can only be discussed and put to the vote after a period of forty-eight hours from its submission.
Only deputies in favor of the motion of censure participate in the vote (which takes place in the lounges adjacent to the meeting room and is open for a duration of 30 minutes); the motion is only adopted if it is voted for by an absolute majority of the members making up the Assembly.
Since the start of the Fifth Republic, 65 motions of censure have been tabled “spontaneously” on the initiative of deputies. Only one was adopted on October 4, 1962, leading to the resignation of the Pompidou Government. The Government has, moreover, engaged its responsibility 114 times on a text leading to the tabling of 84 motions of censure. None of these motions have been adopted so far.
