Following several appeals filed by associations and individuals, the Administrative Court of Marseille took a decision on December 16, 2024 regarding the various pollution caused by industrialization of the southern coastparticularly in the form of visible slag deposits.
Failing to be able to hold the companies responsible for this pollution, because they have disappeared or are unknown, the environmental code designates“lState as ultimate responsible“, can we read in a press release from the Bouches-du-Rhône Prefecture dated December 23, 2024.
Southern coastline: decontamination estimated at €14 million
The judgment of the Court confirms “the need to carry out the safety work undertaken by Ademe on sites defined as priorities in the creeks with regard to their health or environmental sensitivity“.
The State reaffirmed its commitment to respecting the planned work deadlines: securing 20 slag deposits by June 2028. Complex works which will take place in the creeks, between Monte Rosa and Callelonguesites considered priority due to the environmental sensitivity of these areas of the littoral sud. The overall cost of the operation depollution is estimated at 14 M€.
Priority to the environment for the southern coast of Marseille
In the same press release, the Administrative Court of Marseille expressed itself on the case of the former site of the Legré-Mante factory. He returns to the cancellation of the building permits issued to the developers Gingko and Constructa. He also requests the establishment of public utility easements to limit land use in this polluted area.
The site owner must also secure the site. Although it is not the cause of pollution.
In the absence of established damage, the Administrative Court rejected all of the high-amount compensation requests claimed by the individuals.
