Opposition municipal councilor Nicolas Sainte-Cluque, who had drawn the attention of elected officials to the sale of a house to Franck Tournaire well below the price of the Domaines, filed an appeal. He denounces favoritism towards the one who was on Michel Moynier’s list during the 2008 municipal elections. The municipality will withdraw the contested deliberation. Explanations.

A free appeal was filed by opposition municipal councilor Nicolas Sainte-Cluque who denounces a sale at a price that he considers a low price of municipal property, to the detriment, he says, of the interests of Narbonnais. The sale in question of a 150 m house2 with an adjoining plot of 3,281 m2located on the old Chemin de Bages, “sold for more than 120,000 euros well below its market value, would have constituted a real gift to an individual, to the detriment of the City’s public finances”, raises Nicolas Sainte-Cluque in the gracious appeal addressed to the municipality.

Deliberation No. 15 adopted by the majority of voters during the Municipal Council meeting of September 26, 2024, aroused the indignation of the opposition municipal councilor En Commun, Nicolas Sainte-Cluque. It involved the sale of a house of approximately 150 m2 with an adjoining plot of 3,281 m2.

The house had been rented since 2019 to Franck Tournaire with a rent of €550 per month, work estimated at 100,000 euros having been carried out. “Or, indicates the appeal, the Domaines value the house and land complex between a low range of €386,483 and a high range of €423,983 and… the city decides to sell the whole thing at a price of €265,000. There is no invoice for the work and the rent is below the rate. There is no transparency, there was no call for applications for this accession, nor competitive bidding. The deliberation is not justified by any reason of general interest so that it is illegal.”

The town hall withdraws the deliberation

Seized of the gracious appeal by Nicolas Sainte-Cluque which was decided in the event of failure to refer the matter to the administrative court with a view to obtaining the annulment of the deliberation, the mayor decided to withdraw this deliberation. The Aude prefecture, responsible for examining the legality of the deliberation, requested additional information from the municipality on the justification of the price of this transfer.

The production of the required documents does not allow the deed of sale to be signed within the stipulated time limit and thus included in the 2024 budget. The municipality has therefore decided to withdraw the deliberation contested, in order to prepare a second one next year: “In order to avoid any new dispute in the transfer of this asset, as well as the commitment of procedural costs in defense by the municipality, the City of Narbonne will propose in 2025 a new deliberation including more elements justifying the price of the transaction”. The municipal council this Thursday, December 19 should ratify this withdrawal.
