A 58-year-old man is on trial until Wednesday, November 27 by the Lozère criminal court. This Monday, during the first day of the hearing, he refuted the facts of rape, citing consensual sexual relations.
She was 36 years old, as of December 2021. Mentally and physically disabled, she is described as having 5 years of mental age. “A child in a woman's body”, dira son avocate Me Sandrine Andrieu from the Lozère bar. He, Thierry Q., is nineteen years her senior. If he receives the allowance for disabled adults, he will nevertheless be presented as a person “of normal intelligence, who knows the prohibitions”, by the Dr Onesphore Depardieu, expert psychiatrist at the Court of Appeal of Riom (Puy-de-Dôme).
Together, they had sexual relations in Meyrueis, where they both resided at the time of the events. Reports that the thirty-year-old denounces as forced. “He put his penis on me, but I didn’t want that. He hurt me with his hand,” she proclaimed on that last Sunday before Christmas, when she was found crying and prostrate at the end of the afternoon.
“When we have nothing to reproach ourselves for, we don’t apologize”
Thierry Q. has been appearing, since Monday, November 25, 2024, before the Lozère departmental criminal court for rape of a vulnerable person. During the investigation, the fifty-year-old admitted to digital penetration and fellatio. But, according to him, always consented. His semen was also found on the young woman's panties. Medical analyses, particularly gynecological ones, did not reveal rape.
“What is your position today?” President Christian Pasta asked, after summarizing the indictment. “Always the same, the person replied. But I apologize to the victim.” A response that left the magistrate speechless. “You apologize, but when you have nothing to reproach yourself for, you don’t apologize,” he said again. “Yes, but I apologize anyway,” hammered the accused.
Fourteen entries in his criminal record
During this first half-day of hearing, as is customary in criminal matters, the experts took turns to present their report and, thus, paint a portrait of the accused with the 14 mentions on his criminal record (sexual coercion in 2011, a sexual assault in 2012 or even domestic violence with ITT of more than eight days in 2013).
“For him, everything is a pretext for excess anger. His mother is the only female character he does not insult,” said Charlotte Vidal, the personality investigator, by videoconference.
“78% risk of recurrence” according to the expert psychiatrist
The Dr Nicolas Sajus, an expert psychologist based in Rodez, dwelt at length on Thierry Q's childhood wounds. “He is a child born from abuse, with a violent and alcoholic father, he explained. He spoke of his first alcohol use at the age of 6. He stopped his schooling in 4e. He lived through wandering, bad company and addiction. He had several accidents and contracted HIV. He has emotional and substance dependence. With me, he recognized the digital penetrations. He told me: “I hadn't met anyone in three years. I gave up.” The impulse took over.”
The Dr Depardieu, who works in Puy-en-Velay, intervened last. “Thierry Q. does not present psychiatric danger, but criminological danger, he added. The act was of a psychopathic type, dominated by a search for ego satisfaction.” The doctor also assessed, using a technique from Belgium, the risk of recurrence. According to him, and given the personality of the accused, this is 78% within twelve years. “If you condemn him, an injunction for treatment and socio-judicial monitoring seem appropriate,” did he submitted to the court.
The plaintiff on the stand
A counselor-educator from the nursing home where the thirty-year-old resides also intervened, at the very end of the hearing, to talk about her protégé. “She is vulnerable. She has difficulty expressing herself and understanding. She is a very kind woman. She does not see right and wrong, like a child who would not understand that an adult could do so. take from her. Even now, she tells us: “The gentleman hurt me”. She didn't sleep any more. She had nightmares. It is only recently that she has come out of the nursing home.”
The thirty-year-old will travel to the Mende judicial court this Tuesday, November 26. She will come to the stand to explain what she experienced.
