A decree published in the Official Journal of November 23 makes modifications for several legal professions. It takes into account in particular the reform of the ethics and discipline of ministerial officers.
Justice commissioners, notaries and lawyers saw several of their statutory provisions refined by a decree published in the Official Journal (JO) of November 23 (1).
With regard to notaries, the decree updates the texts of the profession to adapt them to the reform of ethics and discipline of ministerial officers. Certain provisions concern the assessment of the capacity and good repute of employed notaries, others clarify the methods for setting tuition fees for notarial training.
With regard to the legal profession, the decree removes the diploma requirement for taking the entrance exam to the regional professional training center (CRFPA). It also introduces a new diploma requirement for taking the exam for the certificate of aptitude for the profession of lawyer (Capa) and provides for the treatment of student lawyers who have completed the three training periods in CRFPA without being still holding the master's degree when passing the Capa.
Finally, the moral conditions for access to the profession are specified for justice commissioners. The decree modernizes the operation of the loan fund, relocates the swearing-in of clerics before the court of appeal instead of the judicial court and limits it to a single service during the first appointment.
