On January 5, 2024, the town planning department of the City of La Baule (-Atlantique) authorized the company SPC Michel Giboire to “demolish a detached house and a garage” located on Allée des Tulipes (along the railway line), to “cut down three trees” on the land base and build a small building 10 meters high instead.

The owners of the house right next door, via their real estate company (SCI), are opposed to this construction and have contacted the administrative court: they fear a “loss of sunshine” and “nuisance” linked to “increased traffic” in their impasse.

“No threat to public safety”

But the Allée des Tulipes measures “8 meters wide” and is “rectilinear”, underlined Tuesday November 19 during the hearing the public rapporteur to the three Nantes judges.


This real estate project “limited to twelve apartments” will therefore not “endanger public security”, according to him.

The Loire-Atlantique Departmental Fire and Rescue Service (Sdis 44) has also given a “favorable opinion” to this residence insofar as “no private parking” is provided for its occupants “on the 'public space'.

A “turnaround area” will also allow fire trucks and other emergency vehicles to turn around at the bottom of the impasse, said the public rapporteur, whose opinions are often followed by judges.

He recommended that they reject the request of the couple who were neither present nor represented by a lawyer at the hearing.

The lawyer for the City of La Baule and the representative of the real estate developer, for their part, made no other observations than those already mentioned in their written briefs.

The Nantes administrative court, which has reserved its judgment, will render its decision in approximately a month.
