Yoann Cliquet has just been sentenced to 15 years of criminal imprisonment on appeal before the Tarn-et-Garonne Assize Court, meeting in Montauban. In May 2020, high on cannabis, this man brutalized and raped his partner.

During the investigation, then in front of the Haute-Garonne jurors, Marie exploded. This young woman, “very in love”, sought to defend Yoann Cliquet, now 29 years old. Yet the one “with whom I had really good times,” she confided before the Assize Court meeting in Montauban, inflicted hours of nightmare on her in the heart of a night in May 2020.

France, and Toulouse, were then behind closed doors imposed by the Covid health crisis. Marie, for her part, was thinking about her life after, obviously with Yoann, her great love. This man did not share these projects, he who had already planned his return to the Paris region. “In reality, that night, he found himself trapped, invaded by the presence of this young woman whom he no longer wanted,” notes Emmanuelle Franck, the victim’s lawyer.

“The electroshock” of the first trial

A woman who, after having long denied the reality of the violence suffered, including rape with the post of a bicycle saddle and a shower with scalding water (!), received “an electric shock” during the first instance trial. “I realized what he had done to me,” she explained to the Tarn-et-Garon jurors who have been judging this case on appeal since Monday.

Can the excessive consumption of cannabis, which had already caused strong delusions in the accused, explain this act? When the attorney general Lisa Bergereau considers that “an alteration of discernment” must be considered and requires 16 years of criminal imprisonment, the defense and in particular Mr. Pierre Debuisson demands from the jurors “a total abolition of discernment which cannot allow a conviction because let us not judge the mad.”

This defense, far removed from psychiatric expertise, was not followed by the jurors. At the end of their deliberations, however, they revised the sentence downwards. Yoann Cliquet is sentenced to 15 years of criminal imprisonment. Marked by the three days of debates, Marie did not wish to speak.
