On May 19 at 3:30 p.m., the police were alerted to domestic violence. Once there, they found a woman indicating that she had been kicked out by her partner, who left the home with their daughter, aged 2 months.
The gendarmes noticed that the young woman had a swollen nose: she explained that she had argued with her partner when returning from a community celebration. She indicates having received “a whim” at the level of the nose and having retaliated in him “ripping off the ear”.
The man, returning a few moments later, said he had left the child with a friend. He has traces of blood and his ear torn off. Alcohol tests are positive in the man and woman: the man is also positive for cocaine.
A “disturbing environment”
During his hearing, the defendant indicated that he had been in a relationship with his partner for 10 months. The latter also has an 11-year-old son, who lives under the same roof. The argument apparently broke out because of a “jealousy crisis” on the part of the defendant. He says he received a first slap in the kitchen, then a second, while he had their two-month-old baby in his arms. Concerning the ear injury, an action attributed to the woman, the couple does not remember the circumstances.
The civil party speaks of the trauma in children, in particular the 11-year-old who saw his mother with a bloody nose, and speaks of a “disturbing environment”.
The court sentenced the defendant to a suspended prison sentence of 6 months. The defendant was sentenced to 8 months' imprisonment, 4 of which were suspended. They will have to compensate each child up to €500 for their moral damage.
