“If he had not met me, this would not have happened,” declared the accused during his hearing, while specifying that his state (1.16 g of alcohol in the blood in addition to cannabis ) had contributed to making it “twist”. According to his statements, reported this Friday, November 8 by the Besançon prosecutor, Etienne Manteaux, it was the sexual propositions of the victim which would have made the defendant angry. And therefore triggered the brawl which cost the life of a 59-year-old man this Thursday, at 1 a.m., in Morteau.

Already convicted of violence

While in police custody, the alleged perpetrator, a 21-year-old Mortuacian, already convicted 4 times – notably for violence – and who was to be tried at the end of the month for acts of the same nature, returned to this evening.

It was at 11:15 p.m. this Wednesday that the victim, a 59-year-old cook living in Montlebon, went to a bar on Place de la Halle at the end of his shift. There he meets a group of young people with whom he starts drinking. “At 12:41 a.m., the man went away with one of the young people in the group,” said the prosecutor, the young person in question being none other than the alleged murderer.

The two men return a few minutes later. The group having left the establishment shortly after, the first two left together. “There was no aggression, animosity or potential subject of conflict noted at that time,” notes Étienne Manteaux.

The hearings of the witnesses nevertheless make it possible to highlight that, during the evening, the fifty-year-old had proposed sexual relations to his attacker. “What happened in the 7 minutes they left the bar? We do not know clearly at this time,” underlines the public prosecutor.

Traces of blood still visible on his sneakers

Still, at 1:15 a.m., police and emergency services were alerted of an attack in progress on rue Fauche. The victim is in cardiorespiratory arrest and the resuscitation attempt will be in vain. Witnesses then recognized the attacker who was immediately apprehended by the police, traces of blood still being visible on his sneakers.

Brought back to the brigade, he was placed in police custody and then subjected to alcohol and drug tests which turned out to be positive. “Very quickly, he will agree to explain himself and admit that he is behind the attacks,” continues the prosecutor.

A search of his home revealed a pair of bloody pants. It turns out that, living near the scene of the attack, he had taken the time to change before returning to the scene a few minutes later.

The man was indicted for aggravated intentional homicide committed because of the sexual orientation of the victim and placed in pre-trial detention. He faces a sentence of life imprisonment.

Three videos of the attack found on his phone

The use of the suspect's phone made it possible to find three videos. “These are three scenes where he films himself attacking his victim,” specifies Étienne Manteaux, who describes violence that is difficult to bear, evoking in particular kicks inflicted on the victim's face.

The young man even sent these images to some of his contacts via the social network Snapchat. In two of these sequences, he insults the victim and in a third, he talks about sexual advances that the fifty-year-old allegedly made to his 14-year-old little sister. An element which could not be confirmed, but suggesting a dispute pre-existing this evening.

A surge of violence

The victim's autopsy revealed a significant series of hematomas and multiple lesions, mainly located on his face and skull.

A “non-fatal” cerebral hemorrhage was also noted. An asphyxial syndrome would be the cause of death “without, at this time, the doctor being able to clearly explain the mechanism”, indicated the prosecution.

Toxicological analyzes should also be carried out to better understand the causes of the victim's death.
