The cour administrative d’appel of Nantes (Loire-Atlantique) disowned this Thursday, November 7, 2024 the twenty residents of the former hotel Le Gerbot d'Avoine, located in the seaside resort of Saint-Quay-Portrieux (Côtes-d’Armor).
They had seized it to make cancel the deliberation of the Saint-Brieuc Armor Agglomération community council (SBAA) approving, in July 2019, the “project declaration” around the expansion and renovation of the establishment.
Resort and gourmet restaurant
The project consists of replacing “a former hotel-restaurant with around thirty rooms” with “ a hotel complex comprising a hotel (…), a hotel residence (…), a gourmet restaurant with sixty seats, a brasserie with around one hundred seats, a spa, an indoor swimming pool and an underground car park with around one hundred spaces”, recontextualizes the courtyard administrative appeal of Nantes.
Strengthening “tourism and gastronomy”
This expansion “meets the objectives of maintaining the classification” of Saint-Quay-Portrieux in “classified tourism resort” : it is “valid until 2027” and “the Quinocean hotel accommodation supply has decreased for several years”, explain the Nantes judges.
The elected officials of the community council also wanted, with this project, to “consolidate the town’s conference city project” which “includes a conference center whose use is mainly limited to daily events”.
More generally, Saint-Brieuc Armor Agglomération thus has “ revive and support employment in the municipality ” but also ” promote local gastronomy« .
The number of jobs created would thus not be “not less than fifty”according to forecasts.
Strengthen the Palais des Congrès
“If the applicants maintain that the congress hall is not not sufficiently equipped to offer an alternative to the Palais des Congrès located in (…) Saint-Brieuc, they do not establish that the project (…) will not make it possible to strengthen the congress hall by hosting seminars lasting more than twenty -four hours,” asserts the court.
Feared densification
The “densification” feared by local residents in this “environment characterized by a low density of seaside villas of high architectural quality” cannot be considered “significant” either, for the Nantes judges, “taking into account the presence” of the “built front of Avenue du Général de Gaulle”, the convention center and a “higher building in R+7” in “immediate proximity”.
“No risk for the cliff”
The Geological and Mining Research Bureau (BRGM) had also ruled out any “risk of disorder” at the level of the cliffs of the tip of Isnain : the sector is not identified as a “priority to secure”. “The applicants also do not establish that the scouring necessary for the creation of the underground car park would present a particular risk in relation to radon”, considers the administrative court of appeal of Nantes, while the “scouring” will nevertheless be “deep” thirteen meters” according to local residents.
Finally, the extension of Gerbot d'Avoine is not considered “located in an area (…) subject to the risk of coastal erosion… since Saint-Brieuc Armor Agglomération ” has not established a local map of exposure of its territory to the retreat of the coastline« .
Caution
However, Saint-Quay-Portrieux “constitutes a municipality whose action in terms of town planning and development policy must be adapted to hydrosedimentary phenomena leading to coastal erosion,” warns the Nantes Administrative Court of Appeal.
In the meantime, immediately, it ordered the applicants to pay 1 500 € to the urban community for its legal costs.
