Legal battle between brother and sister over paternal inheritance

A long legal battle lasting several years continues between a brother and a sister while the latter claims $60,200 from her brother who allegedly poorly ensured the estate of their father who died in 2017.

We can read in the application instituting proceedings which was filed at the Victoriaville courthouse on February 26 that “the rendering of accounts demonstrates numerous irregularities and embezzlement” regarding the expenses of the brother who is the late father’s agent.

“Numerous requests for explanations and justifications […] regarding the assets and liabilities of the estate remained without a satisfactory answer,” the lawsuit alleges.

This is not the first time that the brother and sister have found themselves in court.

In 2018, a year after the death of their father, a Superior Court judge rendered a judgment against the brother in favor of the sister for embezzlement in the execution of his mandate as liquidator.

The sister claims that the brother would have, among other things, taken “$21,100 from the estate for overpayments of various personal expenses” and “$18,000 for retention of the balance of the net assets of the estate”.
