In France, the right to one’s image is governed by law. As a general rule, any person has the right to object to the capture, recording and distribution of their image without their consent. This applies to both photographs and videos. However, there are some exceptions, such as for public figures in a public place, or for crowds in which individuals are not clearly identifiable. Outside of these cases, the unauthorized publication or distribution of a person’s image may incur the civil and even criminal liability of its author, who is liable to damages and sometimes to fines or imprisonment. It is best to find out before distributing your photos!

Even in a public place, the right to one’s image and respect for privacy apply. It is therefore forbidden to photograph people or film them without having obtained their permission. If you are photographing a crowd in which no one is framed in isolation, you can.

“You have to be very careful with photos of children. Don’t do anything without asking their parents. Avoid sharing them online because we don’t know how these photos could be used by people with bad intentions,” recommends Anne-Marie Pecoraro, associate lawyer for UGGC Avocats.
