Me Dina Bazarbachi does not go with the back of the spoon. Monday on “Léman Bleu”, she called on Genevans not to pay and contest the fines issued by the fines department (that is to say those resulting from a criminal order, and not administrative fines) . According to the lawyer known for defending the Roma, these fines are illegal.

She explained it in detail to “Temps” before the holidays: these decisions are provided with a pre-printed signature which does not allow their author to be identified. However, Me Bazarbachi maintains that any criminal decision must bear the handwritten signature of the person who rendered it, supported by the judgment of the Federal Court.

This point of view holds water: in November, the Geneva courts suspended the prison sentence imposed on a beggar due to 135 unpaid fines. Seized of a request for review, the judge considered that the argument of illegality put forward by Me Bazarbachi deserved to be studied. The lawyer therefore invites citizens to oppose the fines received from the fines department. They have ten days to do so upon receipt – after this time, a revision procedure must be initiated, which is costly. And the outcome of which is uncertain, since it is now up to the courts, Geneva and then perhaps federal, to settle the merits of the case.
