Real Estate 2025: are you affected by these new regulations?

The year 2025 marks a pivotal moment for real estate in , with the entry into force of new regulatory obligations. Energy transition, supervision of furnished tourist accommodation and co-ownership reforms: these major changes will affect both individuals and professionals. In its latest press release, the National Real Estate Federation (FNAIM) takes stock of the new developments to anticipate in order to adapt to this new framework.

Energy-intensive housing in the viewfinder

From January 1, 2025, housing classified G in the energy performance diagnosis (DPE) will be declared “indecent”, making their rental illegal. This measure, resulting from the Climate and Resilience law, could lead to a notable reduction in the rental stockparticularly for owners who do not have the necessary means to finance renovation work and are often already involved in a property loan.

For overseas territories, this obligation will be postponed to 2028. In mainland France, housing classified F and E will follow in 2028 and 2034 respectively. Another important change: DPE diagnoses carried out before July 2021 will automatically lose their validity on January 1st. These developments aim to strengthen transparency and accelerate the energy transition of the French real estate portfolio.

Tourism: stricter rules

The furnished tourist accommodation sector, often accused of unbalancing rental markets in large cities, will be subject to reinforced supervision. Mandatory declaration in a national register will now be imposed on all ownerspromoting better regulation.

Municipalities will also have new latitude to reduce the maximum number of rental days authorized for main residences, with a limit between 90 and 120 days. Penalties for exceeding will be increased, increasing to a maximum fine of €15,000.

Modernization and management of co-ownerships

Condominiums will have to adapt to several important reforms. Small buildings, comprising up to 50 lots, will now be obliged to establish a multi-year work plan (PPT)guaranteeing better planning of renovations over a period of ten years.

At the same time, changes will be made to administrative procedures linked to building permits and prior declarations, with the introduction of new standardized forms from the start of the year. These measures aim to simplify and modernize procedures for professionals and individuals.
