At the origin of these significant overpayments lies a problem in the transmission to Pôle emploi (former name of France Travail), of data from the Retirement and Occupational Health Insurance Fund (Carsat). However, the data of certain Carsat beneficiaries would have come into conflict with those held by Pôle emploi. Causing shifts in the “dates of interruption of payment of the ARE […] from a few months to several years”underlines the mediator in his report.

In detail, the main cause of this discrepancy is the fact that Pôle Emploi agencies were until now in the habit of requesting a simple career record provided by job seekers, to record the expected date of their retirement at the rate full. Rather than requiring official proof issued by Carsat. “The incomplete career record had the effect of causing the advisors to record an incorrect forecast date”explains the report.

No retroactivity on retirement pensions

Problem is, the affected beneficiaries must now repay the sums in question… Even though they did not receive payment of their retirement pensions over these periods, since they were still considered job seekers. And Carsat does not provide for retroactivity on the payment of retirement pensions. As a result, the beneficiaries concerned are forced to pay without having the funds to compensate for these errors.

The report describes numerous requests and complaints extended to “all the regions” regarding these overpayments. “These must be subject to specific treatment by Pôle emploi which, on a case-by-case basis, must find solutions adapted to each situation with the other stakeholders concerned,” reminds the mediator. However, given the scale of the situation, the latter sent a warning note on August 30 to the Director General of Pôle emploi. He recommends that the problem be quickly addressed at the national level jointly with the Cnav and Unedic.
