Trump Denied Immunity in Porn Star Case – News

Donald Trump is set to take office on January 20th in the White House as the first ‘felon’, criminal president.

New York judge Juan Merchan rejected the motion to dismiss the guilty verdict for the porn star case, which the tycoon’s lawyers had presented in light of the ruling with which the Supreme Court established immunity for “official actions ” undertaken by the President in the exercise of his functions.

Embracing the prosecution’s thesis, Merchan wrote in his 41-page provision that the evidence shown at the trial concerns “completely unofficial conduct” and recalled that the Supreme Court itself in its ruling recognizes that “not everything that the president ago is official”, not even if he acts from the Oval Office.

The decision preserves the historic conviction which, if confirmed also in Trump’s inevitable appeals, will make him the first convicted felon to serve in the White House. However, the judge has not yet decided whether to issue the sentence before the president-elect is sworn in, after the end of his mandate in 2029, or whether not to issue it at all, but in any case keeping the guilty verdict on record. As the prosecution asks, arguing that Trump’s imminent return to the presidency should not overturn a jury’s decision.

Since it is a state trial, The Donald would not have the opportunity to pardon himself and would be left with this stain. His reaction on Truth was immediate and angry, as the procession of CEOs at Mar-a-Lago continues: “In a completely illegal and psychotic measure, Judge Juan Merchan, deeply in conflict of interest, corrupt, biased and incompetent, he completely disrespected the United States Supreme Court and its historic immunity decision.

But even without immunity, this illegitimate case is nothing more than a rigged hoax. Merchan, who is a radical partisan, wrote an opinion that is knowingly illegal, goes against our Constitution, and, if it stands, would be the end of the presidency as we know it.”

“This must stop! It’s time to end the exploitation of justice once and for all,” he warned. Trump also takes it out on special prosecutor Jack Smith, who however requested and obtained the dismissal of the two federal trials for the assault on the Capitol on January 6, 2021 and the secret papers kept at Mar-a-Lago, surrendering in front of to the fact that Justice Department policy prohibits prosecuting a sitting president and that there would be no time for a hearing before the tycoon takes office.

In the porn star case, however, last May a guilty verdict had already been reached (unanimously) on all 34 charges: falsification of accounting documents to hide the 130 thousand dollars paid in exchange for Stormy Daniels’ silence on a embarrassing night of sex that could have compromised the tycoon’s campaign in 2016. For now, the state trial for attempts to overturn the vote in Georgia in 2020.
