Will Pierre Palmade really go to prison? Like any litigant, he will have to carry out the firm part of his sentence. Because beyond one year, a prison sentence cannot be extended, under an electronic bracelet for example.
“You will very soon be summoned by the public prosecutor of Bordeaux, who will set with you the date and the penitentiary establishment in which you will serve two years of imprisonment,” the president of the court told him, at the statement of the conviction.
Deferred deposit mandate
If he did not go to prison on Wednesday evening, it is because the court issued a deferred committal warrant. This provision has existed since 2020, and allows for a delay between conviction and incarceration.
Pierre Palmade should be incarcerated within four months following his summons before the prosecutor of the Republic of Bordeaux (where he currently lives, and where he is from), according to the code of criminal procedure.
Non-suspensive appeal
The actor has ten days to appeal. But even if he did so, it would not suspend the sentence, since the court ordered his provisional execution.
Once detained, he will nevertheless be able to make a request for release, or modification of his sentence before the sentence enforcement judge, like any incarcerated person, for health reasons for example.
At the end of the prison sentence, “you will have three additional years over your head” of probationary suspension, for three years, the court reminded him. Sanctions which will not be carried out if he respects the obligations pronounced on Wednesday: “try to work, pay the victims, and treat yourself, and not repeat any offense in the next three years”.
The comedian, just before the judgment was pronounced, reiterated his apologies to the victims who stood in the courtroom, seriously injured by the accident: “I have only one word, it is for the victims, I “I hope they can rebuild as best as possible. I saw them in real life today, it shocked me.”
