The Court of Justice of the EU confirms the cancellation of the agricultural and fishing agreements between Morocco and the EU, maintaining them for a period of 12 months for reasons of legal certainty.

Crisis in perspective between Morocco and the EU? The Court of Justice of the European Union has confirmed the annulment of the 2019 EU-Morocco trade agreements. This decision is justified by a “lack of explicit consent of the Sahrawi people, yet essential for their validity”.

The Court also rules on “the problem of the identification and labeling of melons and tomatoes from Western Sahara in a judgment delivered today. It notes, in essence, that this labeling must indicate Western Sahara alone as being the country of origin of these products, excluding any reference to Morocco, in order to avoid misleading the consumer as to their true origin.

In fact, the Court of Justice annuls only one agreement, that relating to agricultural products, because that relating to fishing expired in 2023 and was not renewed.

As regards the agricultural agreement, the Court “maintains, for a period of 12 months from today, the effects of the Council decision, taking into account the serious negative consequences on the external action of the Union which would lead to its immediate cancellation and for reasons of legal certainty”.
