The administrative court of Paris canceled the sanction which had been imposed in October 2022 by the mayor (PS) of the capital, Anne Hidalgo, to an agent who combined his activity as a civil servant with that of a VTC driver.

Two years of disciplinary sanction

This “senior operating agent” within the City’s Department of Public Construction and Architecture (DCPA) – which ensures the maintenance of 3,600 municipal buildings – was specifically excluded from management functions. six months closed and eighteen others suspended.

The community in fact criticized him for having “created a passenger transport vehicle company in 2019” and for having “combined” this activity with his “full-time” job within his services “to the detriment of the time of obligatory rest”. He had “not requested authorization” for this while the City has “put in place several systems aimed at reminding agents of their obligations” in this matter. He had also “signed a charter of ethics” on October 18, 2019 and had “maintained his accumulation” despite the disciplinary procedure.

Impeccable evaluations

“However, it does not appear […] of the file that the accumulation of activity of MX would have had an impact on the exercise of his missions, particularly in view of the quality of his evaluations […]which emphasize its voluntary nature and its application,” objects the Paris administrative court in a judgment dated November 7, 2024, which has just been made public. His activity as a VTC driver was also “carried out outside his working hours” at the DCPA, underline the magistrates.

“Given his seniority at the City of Paris of nearly twenty-five years […]in the absence of disciplinary history […]the applicant is justified in maintaining that his exclusion […] of twenty-four months, eighteen of which are suspended, is disproportionate”, concluded the Paris administrative court – even if the “cumulative activities” in question “constitutive of a fault justifying a lesser sanction”.

The City of Paris has until January 7, 2025 to contest this judgment before the Paris Administrative Court of Appeal.
