For a roundabout story, two motorists argued on August 16, 2023, in the morning, Place Saint-Vincent, in Saint-Malo (Ille-et-Vilaine).

The bird names flew. One of them was driving his daughter to work. The young passenger in turn got out of the vehicle, equipped with a small bomb, the contents of which she sprayed towards the face of the other motorist. “Here, this will refresh your ideas,” she allegedly told him. She says it was just thermal water. The gentleman, however, fell to the ground and his eyes were irritated.

“Water on the face”

“He got up very quickly, his phone in his hand, I turned around when I left with my father,” explains the 21-year-old young woman who maintains that her bomb was not tear gas. “He may have fallen because he was scared, I’m sorry. I don’t understand how it has come to this. The only thing I was guilty of was putting water on his face,” she said, surprised to find herself in court. How does she explain her action?

I wanted the argument to stop, he continued to insult my father. And I had to open the store that employs me.

“It’s a physical attack”

Invited to express themselves, the victim only sees “blabla” in what they say. His lawyer notes that “we will never know the nature of this product. In any case, handling an object that can be compared to a weapon, even an artificial one, is a physical attack. » He asks for €1,500 in damages for his client.

According to the testimonies collected, the prosecutor believes that “we can doubt that there was only water in the bomb. This gentleman’s eyes had to be cleaned with physiological serum.” And even have the police test the two types of liquids to compare the jets with that recorded by a surveillance camera!

It requires two months of suspended prison time and a citizenship training course.

Cyril Baron, for the defense, believes that this case, which he describes as “cornful” because of its “insignificance”, concerns a simple infraction. “The effects of tear gas do not dissipate in a few minutes. A witness did not mention any odor on site. Water is not a weapon. It would be the first time that I have seen someone sentenced for splashing thermal water,” he quips, asking for release.

The Saint-Malo court, which studied the case on Tuesday December 17, will render its decision on February 7, 2025.
