From January 1, 2025, the maximum rental period authorized for a main residence in Paris goes from 120 to 90 nights per year. This flagship measure of the new text carried by deputies Anaïg Le Meur and Iñaki Echaniz may or may not be adopted by the municipalities. The new rule comes with a severe penalty: a civil fine of 15,000 euros if you don't respect it.
The Airbnb platform quickly reacted to this provision, estimating that it “will not have no impact on housing supply availablesince they are by nature occupied all year round by their owner.
Furthermore, the city of Paris is toughening sanctions for illegal changes in the use of housing. Moving from long-term rental to a commercial activity such as furnished rental constitutes a change of use, which requires a prior authorization issued by the town hall. However, this obligation is regularly circumvented: approximately 25,000 furnished tourist accommodations would be rented illegally in the capital. The fine for this type of offense will increase from 50,000 to 100,000 euros from January 1, 2025.
Finally, a new registration requirement is imposed on renters of furnished tourist accommodation, via a national teleservice. Owners must provide a proof of address certifying that the accommodation constitutes their main residence, where a simple declaration on honor was previously sufficient. Any false declaration carries a fine of 20,000 euros.
Namely : the new law also provides for fines for all rental platforms (Abritel, Airbnb, etc.) if they do not remove rental advertisements when the night limit is reached. Concierges, for their part, may be subject to sanctions if they are “complicit in fraudulent rental”.
