2024 Legislative Elections: Placed under guardianship, the ineligible RN candidate remains in the second round in Jura

An ineligible candidate is running in the second round of legislative elections in Jura : Thierry Mosca (RN) submitted his application to the prefecture this Tuesday afternoon, to stand National Rally candidate in the second constituencyHowever, he is ineligible due to his placement under reinforced guardianship. Thierry Mosca, aged 65, came in second. after the first round of these elections with 32.76% of the votes, behind the outgoing LR MP Marie-Christine Dalloz (38.59%). To justify his decision, he considered that only the support of his voters counted: ” I met many people who voted for me and who told me to continue regardless, because we still have to bang our fists on the table.

The left-wing candidate waited at the prefecture… just in case

The candidate of the New Popular Front, Evelyne Ternant (24.75% of the vote) withdrew on Sunday evening, to block the RN. After the revelation of the ineligibility of her RN opponent, she prepared a candidacy file, in case he does not file his. She waited part of the day at the Jura prefecture, to be able to run if Thierry Mosca withdrew.. But he filed his application late in the afternoon and Evelyne Ternant (PCF) confirms her withdrawal. The NFP candidate also denounces the attitude of her competitor: This election is such a denial of sincerity that I do not see how it could be validated. In any case, there will be appeals and it will be up to the Constitutional Council to decide.”

Legal action after the election?

Thierry Mosca has been placed under the guardianship of the Departmental Union of Family Associations (Udaf) of Jura since November 2023. For its part, the Jura prefecture explains that the documents provided at the time of submission of applications do not allow us to know whether a person is under guardianship. On the other hand, in the event of election, a birth certificate is then requested, where this mention may appear. However, “People under guardianship or curatorship are ineligible according to article LO129, but article LO128 provides that only people declared ineligible by the administrative judge or by the Council of State can apply” explains the Jura prefecture. Thierry Mosca is not in this latter case: he can therefore run but An appeal may then be filed after the election. This legal action against could invalidate his possible electionafter the vote.
