Tuesday November 12, 2024, the Laval judicial court (Mayenne) looked into a new case of domestic violence.
The events took place in the marital home, in the Laval area, for more than two years, before the wife decided to file a complaint once again for violence and death threats. She denounced the violence in 2020. Her husband was convicted by the same court.
It was one morning in June, after having been violently dragged out of bed and having received blows, that the wife called the gendarmerie while she took refuge in her car.
When they arrived, the police found the father of the 3 children in front of the car. He insults his wife. The wife explains that her husband's behavior is pushing her psychologically to the limit. She adds that he is unfaithful but jealous. He sleeps out, comments on her clothes, criticizes her for her necklines.
During a previous argument, a blow delivered by the defendant to his wife's face broke her nose. Another time, he threw a knife at her, saying: “ I will kill you, the children will no longer have a mother. » He injures her finger, which will require surgery followed by total incapacity for work for 10 days.
“You are no longer my son”
Their eldest son, aged 9, was interviewed and declared: “ One day, I called the police because Dad hit Mom. » The boy specifies that after that, his father rejected him for 3 days saying: “ You are no longer my son. » He adds: “ When he screams, I'm afraid. Sometimes he insults me and hits me too, I'm sad and terrified. »
In court, the defendant simply acknowledges the arguments. He ends up accepting the shoving but denies having struck and minimizes it.
The civil party’s lawyer specifies: “ This violence was committed in the presence of children who suffered enormously from this situation. »
The prosecutor considers that the defendant was appearing for having been “ a domestic tyrant for over 2 years. He does not recognize the offenses, however serious, with which he is accused.”
“Word against word”
The defense lawyer pleads for acquittal for the knife violence, the broken nose and the death threats, on the grounds that “ it’s word against word, the doubt must benefit him.”
The court acquitted him of the death threat but sentenced him for the other offenses to 12 months in prison under an electronic bracelet, including 6 months with a probationary suspension of 2 years. He has an obligation of care, is prohibited from contacting the victim and from appearing at his home.
