Thursday November 7, 2024, Lucas (1) aged 32, originally from the territory of Grand Figeacappeared before the Cahors criminal court. He is being prosecuted for having usurped the identity of a friend and having created an account without her knowledge, on the dating website: “Coco.fr” (the same site as that used by Dominique Pélicot, in the Mazan rape case).
The events took place in the territory of Grand Figeac and began in December 2022.
Three consecutive complaints
On December 4, 2022, Mme T. (the victim of this affair) files a complaint with the Figeac gendarmerie; she has just learned that her name and contact details appear on the famous dating site already mentioned.
Luke and Mme T. had met at their workplace. Now, Mme T did not wish to pursue a particular relationship with Lucas. Also, upon learning of the creation of this fake account, she suspects Lucas of being behind this approach. The gendarmerie investigators hear Lucas. However, the young man says he is completely foreign to this story and complains on the other hand of being continually taunted by the complainant, who never stops trying to cross his path.
A second complaint is filed, because M's fatherme T also received a call from a subscriber to the same dating site, seeking to contact his daughter. A few days later, it's M's motherme T. who is contacted by a person, via this same site. The affair is taking on worrying proportions.
How can Lucas deny having created this fake account?
The findings of the investigation reveal that M's fake accountme T was created after Lucas left the company where he was an employee in the same capacity as Mme T. Lucas was fired, in fact, due to his alcoholism, some time after Mr.me T moved away from him.
Lucas disputes the facts and speaks of a frame-up against him. But investigators prove that M's fake accountme T was created from the IP address (2) of Lucas' computer. The president asks the defendant to explain:
– “I have never created accounts, real or fake, because I don’t like social networks! » Lucas replies. The president insists:
– “Computer investigations are objective, how could it be otherwise? » she asserts.
Straight in his boots, Lucas stands by his words.
Another element reported at the hearing, Mme T found all four tires of her vehicle punctured, the day she received the summons inviting her to appear at the hearing on November 7, 2024.
Victim of a delusion of persecution?
At the end of the material period, Lucas was subject to forced hospitalization and received psychological support. He would have been suffering from a delusion of persecution; a pathological erotomaniacal fixation (characterized by a delusional and obsessive belief that Mme You would be in love with him). Lucas tells the court that the conclusions of this expert “are erroneous”. And he maintains that he is a victim of the actions of M.me T. Furthermore, he has a clean criminal record.
Me Mustapha Yassfy, comes out of his gongs after hearing Lucas' statements! He exclaims: “This man makes fun of everyone, the court, the hospital.” Then, he brandishes the report in which is recorded the observation that the IP address of Lucas's computer is indeed the one used to open his client's false account.
– “He says it’s not him, when it’s the IP address that’s talking, it’s not me!” » exclaims Me Yassfy. For the former president, there is no doubt, it was Lucas who created this fake account to take revenge on the woman who did not want him. “This is irrefutable proof! » he adds. Me Yassfy affirms that his client was terrorized by the actions of the defendant, who posted on the site despicable photographs associated with M's account.me T. He requests €2,500 for moral damages and €800 for lawyer's fees.
“The IP address that was used to create this fake account is indeed that of Lucas’ computer! » adds Patrick Serra, Deputy Public Prosecutor. “There’s no doubt about it! » he insists. He requires 6 months in prison against Lucas, with probationary suspension for 2 years, obligation of care, ban on coming into contact with the victims and coming to their homes for 2 years.
Could it have been the target of hackers?
Me Véronique Mas, Lucas' lawyer, does not let herself be shaken by the certainties relating to the IP address of her client's computer. She recalls how her client always denied being behind the creation of M's false profile.me T on the dating site. The first complaint having been filed on December 4, 2022, it notes that there is no traffic from this IP address between December 3, 2022 and January 10, 2023. It considers that there is no of certainty as to Lucas' guilt, that nothing proves that he was the creator of this false account. Could it have been the target of hackers? She asks for Lucas' release, for the benefit of the doubt.
Conviction of the accused
After deliberating, the court sentenced Lucas to 6 months in prison suspended for 2 years, with obligations for psychological and psychological care, ban on going to the victims' homes, ban on entering into relationships with them. Lucas will have to pay €1,000 to Mme T for moral damage, plus €800, for lawyer's fees. He has 10 days to file an appeal.
