The criminal court sentenced, Tuesday October 8, 2024, a motorist of Martigné-Ferchaud (Ille-et-Vilaine) who found himself in contraflow on the four lanes at the level of Retiers with its cart while he was alcoholic.

2.42 g of alcohol per liter of blood

On September 9, 2023, this retiree was spotted at the wheel of his cart, around 10 p.m., while he was driving on departmental road 173 in the wrong direction. Motorists had raised the alarm.

The septuagenarian was driving on the left lane, on the side of the safety rail and had almost hitting a family who was coming in front.

The police managed to block his cart and extract the 75-year-old man to safety. They found him “disoriented”.

The septuagenarian couldn’t speak, he smelled of alcohol and didn’t know where he came from or where he was going. The blood alcohol test proved difficult: the retiree was initially unable to breathe.

He actually had 2.42 g of alcohol per liter of blood. He ended up explaining that he had “drank with friends” and then decided to “go and see his son” who was playing “music in a bar”.

“If there hadn’t been any cars coming in front, I would have managed to turn around,” the retiree is convinced.

Asked about his “lucidity” to drive, the motorist explained that he was “aware” of the situation since he had “put himself on the rail”.

He actually wanted to “take the ramp in the wrong direction” to get off the dual carriageway.

“It’s getting worse and worse what you’re saying, sir,” the president cut her off, noting that he was “ very dangerous» to find themselves on the same road as him.

It has also already been convicted four timesagain for traffic violations and his license was canceled.

“Are you looking for someone to end up killed?” », Launched the public prosecutor to this “public danger” who was content to remain silent.

“I’ve never had an accident, not even a collision! »

The representative of the Rennes public prosecutor’s office therefore explained that she was “on the verge of requiring a prison sentence”, but she agreed that she had to be “given one last chance” by demanding “day fines” for a total amount of 1 200 €.

The defense lawyer, for his part, explained that he himself had traveled the route on which his client had been intercepted, and he “did not understand how he could have ended up going the wrong way”.

But “once on it, he was caught like an animal in a trap,” he clears him. Furthermore, for this retiree who lives in Martigné-Ferchaud, a “fairly remote” village, this license-free cart “allows him to do his shopping and maintain a minimum of social life,” said Mr. Philippe Gresle.

“I’ve never had an accident, not even a collision! », concluded the defendant at the bar.

He was finally sentenced to120 day fines of €8. If he does not pay this sum of €960 within four months, he will be able to serve the unpaid days in detention.
