The Public Procurement Regulatory Authority (ARCOP) recently made a significant decision concerning a public procurement linked to the Spanish company AEE POWER SENEGAL. The move follows concerns expressed by the Spanish Bank Santander and the Spanish Export Credit Agency (CESCE).
These institutions raised concerns about the use of start-up advance funds, amounting to 37,733,592,000 FCFA, which would have been paid to the company without them receiving satisfactory answers to their important questions. In this context, ARCOP decided, as a precautionary measure, to suspend execution of the contract while waiting for the Dispute Resolution Committee (CRD) to rule on the situation. This decision aims to ensure fairness, transparency and impartiality in the processing of public procurement in Senegal.

In addition, ARCOP noted that the Senegalese Rural Electrification Agency (ASER) did not provide the market files required by the CRD. This omission further complicates the contract evaluation process and could have significant repercussions on the completion times of the rural electrification project. The Director General of ARCOP is responsible for notifying this decision to stakeholders, including AEE POWER SENEGAL, AEE POWER EPC, the Central Directorate of Public Procurement, as well as the Ministries of Finance and Energy, Oil and Mines . This notification will also be published on the public procurement portal to ensure transparency of the process.
