On Monday, Kendji Girac was hospitalized in serious condition, after being shot in the chest. The singer was inside his caravan, on a traveler’s area in Biscarrosse (Landes), with his wife and daughter.

Although he initially mentioned an “accidental shooting”, he finally explained to investigators that he wanted to “simulate a suicide”, with a recently acquired weapon, to scare his partner who was threatening to leave him. A theory of simulated suicide on which the public prosecutor expressed reservations, Kendji Girac’s partner having declared to investigators that he had already expressed suicidal thoughts to her, and suicide being taboo in the Traveler community.

“Justice will end there”

Initially opened for “attempted voluntary homicide”, the investigation is now moving towards a suicide attempt or a simulation of a suicide attempt, as Kendji Girac affirmed during his hearing.

“Neither one nor the other” of these hypotheses “correspond to criminal offenses”, explained Olivier Janson, during his press conference, adding: “justice is never intended to investigate the causes of a passage to a suicidal act.”

“It’s the privacy of individuals. Justice will stop there,” continued the prosecutor, before concluding: “barring any new events”, the investigation “should end with a classification” without further action. If the theory of attempted suicide or simulation of a suicide attempt is confirmed, the singer will not be prosecuted for his actions.

“Criminal law is not just a sanction”

But for the moment, the investigation for “attempted intentional homicide” is still open. Firstly to confirm current hypotheses, including that of a suicide attempt, but above all to find out where the weapon used on the evening of the tragedy came from, a 1911 model semi-automatic pistol. This handgun category B requires authorization to be held.

During the first hearings, Kendji Girac initially claimed to have bought his weapon at a flea market. To the investigators, he finally explained that he had obtained it for 500 euros from a man, who did not come from the Traveler community and who was visiting the camp. The latter has not yet been identified.

During his hearings, the singer also admitted to having “drank a lot” and used cocaine. If the possession of a weapon and the consumption of drugs are reprehensible, the prosecution is not considering proceedings against the singer.

“Judicially, we can consider prosecution. Naturally the weapon will not be returned to him and will eventually be destroyed. Now, criminal law is not limited to the search for a sanction but also to a form of deterrence,” explained the public prosecutor.

“I have the impression that through what he says (…) that there would be a superfluous side while he was between life and death to come today to initiate a specific trial of this point of view there. I think the lesson is widely understood,” concluded Olivier Janson.
