The same day of his inauguration ceremony as 47e President of the United States, during which the richest man in the world Elon Musk performed a Nazi salute twice, Donald Trump, without delay, began to apply his xenophobic program, by signing, Monday January 20, a series of decrees.
Among the latter, there is one which calls into question land law. But a coalition of 22 Democratic states, including California and the State of New York, announced on Tuesday January 21 that they were filing a complaint against this text. Two separate complaints were filed.
One was in federal court in Massachusetts on behalf of 18 states. It follows a similar complaint filed by the ACLU, a historic civil rights association, and other organizations in New Hampshire. If the decree is maintained, it must come into force 30 days after its signing.
A “frankly unconstitutional and un-American” decree
Land rights are, however, guaranteed by the 14e amendment to the Constitution, adopted after the Civil War to guarantee rights to former slaves and their children. It indicates that “all persons born or naturalized in the United States and subject to the jurisdiction of this country are citizens of the United States and of the State in which they reside”. It thus allows anyone born in the United States to obtain American citizenship.
If the executive order signed by Donald Trump is implemented, it would prevent the federal government from issuing passports, citizenship certificates or other documents to children born in the United States unless one of their two parents has nationality or has permanent resident status.
-“This decree aimed at abolishing land rights is frankly unconstitutional and un-American”said Rob Bonta, Attorney General of California, in a statement. “We ask the court to immediately block the entry into force of this executive order and ensure that the rights of children born in the United States affected by this executive order remain in force during the duration of the proceedings”he added. “The president went well beyond the scope of his duties with this decree, and we will hold him accountable”he continued.
