A 75-day reprieve for TikTok

Adopted by Congress in April 2024 and entered into force on January 19, 2025, a law requires ByteDance – the Chinese parent company of TikTok – to sell the platform under penalty of ban on American territory. It also provides for heavy financial penalties for internet service providers and application stores that continue to offer TikTok, with fines of up to $5,000 per user (we'll let you do the math).

However, the application of the law was temporarily frozen on Monday by presidential decree. Donald Trump justified this delay by citing the need to consult his advisors and assess whether the measures taken by TikTok to secure the data of American users are sufficient.

Let us specify that cet executive order leaves ByteDance with a 75-day reprieve to comply with the new legislation. Otherwise the law must apply. This decision marks a turning point in the approach towards the famous video sharing platform, which has more than 170 million American users.
