Google was sentenced on Wednesday in France to 2,000 euros in damages after having late dereferenced pornographic videos in dispute, according to an order from the Paris judicial court of which AFP was aware.
In this case, a complainant, who wishes to remain anonymous, asked Google in July 2023 to dereference several pornographic videos in which she appeared, due to their illegal nature.
The complainant has in fact filed a civil suit in the French Bukkake case, named after a pornographic site closed due to accusations against its administrators. Several of them were charged, notably for gang rape and aggravated pimping.
After several requests made by the complainant, Google finally delisted several dozen links in April 2024.
In the order issued on Wednesday, the Paris court nevertheless considered that this reaction, which came several months after the initial request, could not be considered “prompt”. He concluded that the company had not acted in accordance with the requirements of the Digital Service Act (DSA), the European regulations in force.
“This is an extremely important victory which confronts Google with its responsibilities,” Céline Piques, spokesperson for the association Dare to Feminism!, who accompanied the complainant, told AFP.
“Google must now provide the necessary means to dereference sexual content with dexterity, efficiency and speed.”
Asked by AFP, Google did not react immediately.
